Charges dropped in RCMP breach-of-trust case as key evidence changed

The Alberta Crown Prosecution Service discontinued proceedings against Sergeant Sheldon Robb and former Mountie Daniel Mayowski, who were accused of breach of trust related to a sexual relationship.

Prosecutors have dropped charges against an RCMP sergeant and a former Mountie accused of breach of trust related to an alleged sexual relationship with a woman.

The Alberta Crown Prosecution Service discontinued proceedings against Daniel Mayowski, now a civilian, and Sergeant Sheldon Robb, who were working in K Division's traffic services unit when they were charged last summer. Mayowski's charge was stayed June 26, while the charge against Robb was withdrawn April 23.

A Crown spokesperson said the decision came after reassessment of the evidence. "For a matter to proceed, there must be a reasonable likelihood of a conviction and the matter must be in the public interest," Michelle Davio said. "In each of these files, key evidence changed. Crown prosecutors conducted a reassessment of these files and determined the available evidence was not sufficient to proceed."

The Alberta Serious Incident Response Team opened an investigation into the officers Feb. 16, 2024, and laid charges last August. According to court records, both officers were accused of breaches of trust "in connection with the duties of (their) office by engaging in a personal sexual relationship" with the same woman.

At the time charges were laid, Mayowski was a sergeant based in Westlock and Robb was in Morinville. The charges against Mayowski covered October 2022, while Robb's covered Jan. 1, 2020 to Jan. 31, 2024.

Robb remains suspended with pay pending a code of conduct investigation. While stayed charges can be revived by the Crown within one year if new evidence emerges, withdrawn charges end prosecution permanently.
