Canadians harmed by the prescription drug Rexulti have until Monday, July 27, 2026, to file claims in a $4.75-million court-approved settlement.
The class-action lawsuit, filed by Rochon Genova and authorized in 2021, alleged that Rexulti can cause compulsive gambling, hypersexuality, binge-eating, and uncontrollable shopping — and that manufacturers Otsuka Canada Pharmaceutical Inc. and Lundbeck Canada Inc. failed to warn patients and doctors of these risks. The defendants agreed to pay without admitting liability.
Eligible claimants took Rexulti for at least one month between February 16, 2017, and August 23, 2025, and developed one or more of the compulsive disorders listed above.
Compensation ranges by severity of psychological harm: $6,531.25 for mild cases, $29,687.50 for moderate, $102,600 for severe, and $71,250 for catastrophic. Claimants need documentary proof of prescription, medical records, and signed attestations.
A separate $570,000 pool covers documented financial losses — gambling losses, lost income, or loans tied to gambling caused or worsened by the drug. Family members can receive a percentage of the eligible member's psychological harm payout, capped at $199,500 total.
The remaining settlement funds cover administration ($55,000) and court-approved legal fees ($1.425 million).
All completed claim packages must be submitted or postmarked by July 27, 2026. The claims administrator will determine compensation levels, with an appeal process available.
