Four Calgary residents are facing manslaughter and related charges in connection with a January 2024 home invasion that left John Wayne Davis dead. Defence lawyers argued Friday that evidence against three of the accused falls short of meeting the test for trial.

On Jan. 4, 2024, police responded to a call on Braden Crescent N.W. and found Davis deceased with two other home occupants injured. All four accused—Jarvais Ljay Eisnor, Troy Jordan Lemke, Alexandra Faith Doman, and Ryo Allan Nelson—each face 10 charges including manslaughter with a firearm, three counts of break and enter to commit robbery, three of unlawful confinement, two aggravated assaults, and robbery with a firearm.

Defence counsel for Eisnor, Lemke, and Doman argued to Justice Karim Jivraj that the Crown hadn't met the low threshold to commit their clients to trial. However, Nelson's lawyer, Ryan Persad, conceded the Crown had met the test for his client. "Mr. Nelson will not be contesting committal," Persad told the court.

Crown prosecutors Michelle Kai and Sabrine Koudmani called 23 witnesses during the preliminary inquiry, which began last October. A publication ban remains in place on evidence. Eisnor, Lemke, and Nelson remain in custody pending case resolution, while Doman is out on bail. Justice Jivraj will hand down his decision on the committal at a date to be determined.
